第一章 总则
Chapter One General Provisions
第一条为了加强本市测绘地理信息管理，规范测绘活动，减少重复建设和资源浪费，提高地理信息资源共建共享水平，维护国家地理信息安全，根据《中华人民共和国测绘法》《广东省测绘条例》《广东省城乡规划条例》等有关法律、法规，结合本市实际，制定本办法。
Article 1
These Measures are formulated for the purposes of strengthening the administration of surveying, mapping and geoinformation of this City, regulating surveying and mapping activities, reducing duplicate construction and waste of resources, promoting collective construction and sharing of geoinformation and maintaining the security of national geoinformation in accordance with such laws and regulations as the Surveying and Mapping Law of the People’s Republic of China, the Provisions of Guangdong Province on Surveying and Mapping and the Provisions of Guangdong Province on Urban and Rural Planning and in light of the actual situations of this City.
第二条在本市行政区域内从事测绘活动、使用测绘成果、提供地理信息服务，应当遵守本办法。军事测绘按照有关法律、法规的规定执行。
Article 2
These Measures shall be observed in the process of conducting surveying and mapping activities, using surveying and mapping results and providing geoinformation services within the administration region of this City, Military surveying and mapping shall be implemented in accordance with the provisions of relevant laws and regulations.
第三条市、区人民政府应当加强对测绘地理信息工作的领导，将测绘地理信息事业纳入本级国民经济和社会发展规划。基础测绘、永久性测量标志普查和维护管理、地理国情监测、应急测绘等公益性测绘，所需经费列入本级财政经费预算。
Article 3
The people’s governments at the municipal and district levels shall strengthen the leadership of the work of surveying, mapping and geoinformation and incorporate such work into the plan for national economic and social development at the corresponding level. The funds needed for basic surveying and mapping, the census, maintenance and administration of permanent surveying markers, geographic condition monitoring and such public welfare surveying and mapping as emergency surveying and mapping shall be incorporated into the fiscal budget of the government at the corresponding level.
第四条市测绘地理信息主管部门负责全市测绘地理信息工作的统一监督管理。区测绘地理信息主管部门负责本行政区域内的测绘地理信息管理工作，并接受市测绘地理信息主管部门的监督及指导。
市、区人民政府其他有关部门依据本级人民政府规定的职责分工，负责本部门有关的测绘地理信息管理工作。
Article 4
The competent department of surveying, mapping and geoinformation at the municipal level shall be responsible for the unified supervision and administration of the surveying, mapping and geoinformation work of this City. The competent departments of surveying, mapping and geoinformation at the district level shall be responsible for the surveying, mapping and geoinformation within their respective administration regions under the supervision and guidance of the competent department of surveying, mapping and geoinformation at the municipal level.
Other relevant departments of the people’s governments at the municipal and district levels shall be responsible for the management of relevant surveying, mapping and geoinformation in accordance with the divisions of duties and functions prescribed by the people’s government at their corresponding level.
第二章 测绘基准和规范
Chapter Two Surveying and Mapping Datums and Standards
第五条在本市从事测绘活动，应当采用全市统一的平面坐标系统和高程系统，应当执行国家、省、市有关的测绘地理信息技术规范和标准。
市测绘地理信息主管部门和市有关部门可以根据国家和本省的测绘地理信息技术规范和标准，补充制定本市的测绘地理信息技术规范和标准。
Article 5
In the process of carrying out surveying and mapping activities in this City, a municipal unified horizontal coordinate system and vertical system of this City shall be employed and relevant technical norms and standards of surveying, mapping and geoinformation of the State, the Province and this City shall be enforced.
The competent department of surveying, mapping and geoinformation and other relevant departments at the municipal level may formulate supplementary technical norms and standards of surveying, mapping and geoinformation of this City in accordance with the national and provincial technical norms and standards thereof.
第六条市测绘地理信息主管部门负责组织建立地理信息时空数据中心和共享平台,管理本市地理信息数据。时空数据中心包括市级地理信息时空数据库和区级地理信息时空数据库，市级地理信息时空数据库向区级地理信息时空数据库分发地理信息数据。
政府部门或者财政投资建立的涉及测绘地理信息的相关专业信息系统，应当以地理信息共享平台为基础平台。建立地理信息系统或者建立与地理信息系统有关的其他信息系统，应当采用时空数据中心提供的基础地理信息数据。
Article 6
The competent department of surveying, mapping and geoinformation at the municipal level shall be responsible for organizing to establish a spatiotemporal data center and a sharing platform of geoinformation to manage geoinformation data of this City. The spatiotemporal data center shall include geoinformation databases at both municipal and district levels. The geoinformation database at the municipal level shall send geoinformation data to the geoinformation databases at the district level.
Where relevant professional information systems related to surveying, mapping and geoinformation are established by the governmental departments or invested by fiscal funds, the sharing platform of geoinformation shall be taken as the basic platform for such systems. Where geoinformation systems or other information systems related to geoinformation are to be established, the basic geoinformation data provided from the spatiotemporal data center shall be adopted.
第七条市测绘地理信息主管部门应当依据相关法律、法规、标准的要求对本市卫星导航定位基准站的建设、运行维护进行统一监管,并负责制定使用、管理本市连续运行卫星定位服务系统的相关规定及制度，保障本市连续运行卫星定位服务系统的应用推广和有效使用。
Article 7
The competent departments of surveying, mapping and geoinformation at the municipal level shall exercise unified supervision over the establishment, operation and maintenance of the satellite navigation positioning datum station of this City as required by relevant laws, regulations and standards, and shall be responsible for formulating relevant regulations and rules on the usage and the administration of the continuous operational reference system of this City to guarantee its application, promotion and effective usage.
第三章 基础测绘和其他测绘
Chapter Three Basic Surveying and Mapping and other Survey and Mapping
第八条市测绘地理信息主管部门应当会同市人民政府有关部门组织编制市基础测绘规划，报市人民政府批准，并报省测绘地理信息主管部门备案后组织实施。
Article 8

市测绘地理信息主管部门应当会同市发展改革主管部门，根据市基础测绘规划，编制本市基础测绘年度计划，并分别报上一级主管部门备案后组织实施。

区测绘地理信息主管部门应当按照市测绘地理信息主管部门编制的基础测绘规划和年度计划开展本行政区域内的基础测绘工作。
The competent departments of surveying, mapping and geoinformation at the district level shall carry out the basic surveying and mapping in their respective administration regions in accordance with the plans and annual plan for the basic surveying and mapping formulated by the competent department of surveying, mapping and geoinformation at the municipal level.
市、区财政部门应当参照批准通过的基础测绘规划和年度计划，核拨基础测绘经费。
The fiscal departments at the municipal and district levels shall inspect and allocate funds for the basic surveying and mapping in accordance with the approved plan and annual plan for basic surveying and mapping.
第九条市测绘地理信息主管部门负责下列基础测绘工作：
（一）全市统一的平面控制网、高程控制网的建立、更新与维护；
（二）佛山市连续运行卫星定位服务系统的建设、运营与维护；
（三）全市基础航空摄影和基础遥感资料的获取；
Article 9
The competent department of surveying, mapping and geoinformation at the municipal level shall be responsible for the following work of basic surveying and mapping:
(1) Establishing, renewing and maintaining a unified horizontal control network and elevation control network of this City;
(2) Establishing, operating and maintaining the continuous operational reference system of Foshan City;
(3) Obtaining the basic aerial photographs and the basic remote sensing data;
(四)配合省测绘地理信息主管部门做好全市1:5000比例尺地形图、影像图，数字化产品以及相应深化产品的测制与更新；
（五）全市1:2000地形图、影像图、数字化产品以及相应深化产品的测制与更新；
（六）全市城市三维模型、地名地址数据、兴趣点、1:500比例尺地形图、数字化产品以及相应深化产品生产与更新的统筹；
(4) Cooperating with the competent department of surveying, mapping and geoinformation at the provincial level in surveying, making and renewing the municipal topographic maps on the scale of 1: 5000, photomaps, digital products and the corresponding updated products;
(5) Surveying, making and renewing the municipal topographic maps on the scale of 1: 2000, photomaps, digital products and the corresponding updated products;
(6) Making an overall planning of the manufacturing and renewing of the municipal urban 3D models, place names and address data, interest points, topographic maps on the scale of 1: 500, digital products and the corresponding deepened products;
（七）全市唯一的基础地理信息系统、地理信息时空数据库、地理信息共享平台的建设与维护；
（八）全市基础地理底图的绘制；
（九）国务院、省、市测绘地理信息主管部门确定的其他基础测绘事项。
(7) Establishing and maintaining the only basic geoinformation system, spatiotemporal database and sharing platform of geoinformation of this City;
(8) Drawing the geographical base map of topography of this City; and
(9) Other items of basic surveying and mapping that are prescribed by the competent departments of surveying, mapping and geoinformation of the State Council, the Province or this City.
第十条区测绘地理信息主管部门负责下列基础测绘工作：
（一）本行政区域内四等以下平面控制网、四等（含）以下高程控制网的加密、维护和更新；
（二）按照市测绘地理信息主管部门的统筹安排，开展本行政区域内城市三维模型、地名地址数据、兴趣点、1:500比例尺地形图、数字化产品以及相应深化产品的生产与更新工作；
Article 10
The competent departments of surveying, mapping and geoinformation at the district level shall be responsible for the following basic surveying and mapping work:
(1) Encrypting, maintaining and renewing the horizontal control networks below class four (exclusive), and the elevation control networks below class four (inclusive) within their respective administration region;
(2) Manufacturing and renewing the municipal urban 3D models, place names and address data, points of interest, the topographic map on the scale of 1: 500, digital products and the corresponding updated products in accordance with the overall planning made by the competent department of surveying, mapping and geoinformation at the municipal level;
（三）基于市测绘地理信息主管部门建设的地理信息时空数据库及地理信息共享平台开展本行政区域内地理信息的扩展应用与维护工作；
（四）市测绘地理信息主管部门确定的其他基础测绘事项。
(3) Expanding the application of geoinformation and maintaining the geoinformation within their respective administration region based on the spatiotemporal database and sharing platform of geoinformation established by the competent department of surveying, mapping and geoinformation at the municipal level; and
(4) Other items related to basic surveying and mapping that are prescribed by the competent department of surveying, mapping and geoinformation at the municipal level.
第十一条基础测绘成果应当按照下列规定定期更新或者及时更新：
（一）全市统一的平面控制网、高程控制网至少5年更新一次；
（二）城市建成区1:500比例尺地形图每年更新一次,其它区域至少2年更新一次；1:2000比例尺地形图至少2年更新一次；1:5000比例尺地形图至少5年更新一次；
（三）1:2000或1:5000比例尺的影像图每年更新一次。
经济建设、社会发展、应急管理急需的基础测绘成果应当及时更新。
Article 11
The basic surveying and mapping results shall, in accordance with the following stipulations, be upgraded on a regular basis or in a timely manner :
(1) The unified common horizontal control network and elevation control network of this City shall be upgraded at least once every five years;
(2) The topographic map on the scale of 1: 500 of the urban built-up area shall be upgraded once a year and that of other areas shall be upgraded at least once every two years; the topographic map on the scale of 1: 2000 shall be upgraded at least once every two years; the topographic map on the scale of 1: 5000 shall be upgraded at least once every five years; and
(3) The photomaps on the scale of 1:2000 or 1: 5000 shall be upgraded once a year.
The basic surveying and mapping results needed for economic construction, social development and emergency administration shall be upgraded in time.
第十二条使用财政资金的测绘地理信息项目和涉及测绘地理信息的其他使用财政资金的项目中，由区测绘地理信息主管部门组织实施的，在报区财政部门批准立项前应当征求市测绘地理信息主管部门的意见；由市、区其他部门组织实施的，在报财政部门批准立项前应当征求同级测绘地理信息主管部门的意见。市、区测绘地理信息主管部门应当自收到征求意见材料之日起10个工作日内反馈意见。
市、区测绘地理信息主管部门提出已有适宜测绘成果可供利用不需要进行实施的，有关部门应予核查，确属重复建设的，不得批准立项。
Article 12
Where the fiscally funded projects of surveying, mapping and geoinformation and other fiscally funded projects concerning surveying, mapping and geoinformation are implemented through the organization of the district competent departments of surveying, mapping and geoinformation, such projects shall be submitted to the municipal competent department of surveying, mapping and geoinformation for opinions and then submitted to the district fiscal departments for project approval; and the projects that are implemented through the organization of the municipal competent departments of surveying, mapping and geoinformation shall be submitted to the competent department of surveying, mapping and geoinformation at the same level for opinions and then submitted to the fiscal department for project approval. The competent departments of surveying, mapping and geoinformation at the municipal and district levels shall give their feedback within 10 working days after receiving the document for opinions.
Where competent departments of surveying, mapping and geoinformation at the municipal and district levels hold that certain suitable surveying and mapping results are available for use and there is no need for implementation of a project, relevant departments shall carry out inspections thereof. In case the project is confirmed to be a duplicate construction, it shall not be approved.
第十三条市、区测绘地理信息主管部门应当会同本级人民政府其他有关部门依法开展地理国情监测，并做好地理国情监测数据的深度开发，通过地理信息共享平台向政府部门和社会公众发布相应成果。
Article 13
The competent departments of surveying, mapping and geoinformation at the municipal and district levels shall, in conjunction with other relevant departments of the people’s government at the corresponding level, carry out geographic condition monitoring, further develop the data thereof and publish the corresponding results to governmental departments and the society through the sharing platform of geoinformation.
第十四条市测绘地理信息主管部门应当会同市不动产登记主管部门组织制定本市统一的不动产测绘相关管理技术标准。
市、区测绘地理信息主管部门应当会同本级不动产登记主管部门编制本行政区域的不动产测绘规划，不动产测绘规划应当与基础测绘规划相衔接。
Article 14
The competent departments of surveying, mapping and geoinformation at the municipal level shall, in conjunction with the competent department of real estate registration at the municipal level, organize to formulate the unified administration and technical standards of real estate surveying and mapping of this City.
The competent departments of surveying, mapping and geoinformation at the municipal and district levels shall, in conjunction with the competent department of real estate registration at their corresponding level, compile plans of real restate surveying and mapping within their respective administration regions, which shall be connected with the plans of basic surveying and mapping.
第十五条市测绘地理信息主管部门应当会同市规划主管部门组织制定本市统一的规划测绘相关管理技术标准。
规划管理涉及的测绘活动，由各区规划主管部门按照市测绘地理信息主管部门制定的标准负责具体管理实施，并接受市测绘地理信息主管部门的监督指导。
Article 15
The competent departments of surveying, mapping and geoinformation at the municipal level shall, in conjunction with the competent department of planning at the municipal level, formulate unified administration and technical standards related to the planning of surveying and mapping of this City.
The surveying and mapping activities involved in the planning and administration shall be managed and implemented by the competent departments of planning at the district level in accordance with the standards formulated by the competent departments of surveying, mapping and geoinformation at the municipal level under the supervision and guidance of the competent departments of surveying, mapping and geoinformation at the municipal level.
第十六条城市地下管线的测绘管理工作按照法律、法规以及本市相关规定执行。
Article 16
The administration of surveying and mapping urban underground pipe network shall be implemented in accordance with laws, regulations and relevant stipulations of this City.
第十七条市测绘地理信息主管部门负责统筹本市应急测绘保障工作，制定应急测绘保障预案，建立应急测绘专家库和应急测绘队伍，完善应急测绘车辆、仪器设备等基础设施建设，加快应急测绘新技术应用和储备。
Article 17
The competent department of surveying, mapping and geoinformation at the municipal level shall be responsible for making overall planning of guaranteeing the emergency surveying and mapping, formulating guarantee plans, establishing expert databases and teams for emergency surveying and mapping, improving the construction of such facilities as vehicles and equipment for emergency surveying and mapping, and accelerating the application and reserve of new technologies for emergency surveying and mapping.
第四章 测绘地理信息市场
Chapter Four Surveying, mapping and geoinformation market
第十八条市测绘地理信息主管部门负责制定并组织实施本市测绘地理信息行业信用管理制度。
在本市从事测绘活动的测绘单位，应当按照市测绘地理信息主管部门要求办理信用登记。
Article 18
The competent department of surveying, mapping and geoinformation at the municipal level shall be responsible for formulating the administrative rules of credit in surveying, mapping and geoinformation sector and organizing to implement such rules.
The surveying and mapping units that engage in surveying and mapping activities in this City shall conduct credit registration as required by the competent department of surveying, mapping and geoinformation at the municipal level.
第十九条市、区测绘地理信息主管部门在开展日常监管、专项检查和表彰评优等工作时应当将测绘单位的信用信息和信用评价情况作为参考依据。
测绘项目招标活动，应当将测绘单位的信用信息和信用评价情况作为评分指标。
市、区测绘地理信息主管部门应当将测绘单位的信用信息和信用评价情况共享至市公共信用信息管理平台，依法建立与发改、工商、税务等相关部门的信用信息共享机制。
Article 19
When carrying out daily supervision, special inspections and commending and awarding etc., the competent departments of surveying, mapping and geoinformation at the municipal and district levels shall refer to the credit information and credit rating of the surveying and mapping units.
In bidding for surveying and mapping projects, the surveying and mapping units shall be scored in accordance with their credit information and credit rating.
The competent departments of surveying, mapping and geoinformation at the municipal and district levels shall share and upload the credit information and credit rating about the surveying and mapping units to the public platform of credit information administration of this City and establish a credit information mechanism shard with departments of development and reform, industry and commerce and tax.
第二十条测绘单位在本市行政区域内设立的分支机构，不具有法人资格的，应当向分支机构所在地的测绘地理信息主管部门备案。
Article 20
Where the branch set up by a surveying and mapping unit within the administration region of this City does not have the status of a legal person, such branch shall report to the competent department of surveying, mapping and geoinformation of the branch’s location for record-filing.
第二十一条在本市从事测绘活动的专业技术人员应当具备国家规定的相应执业资格条件。
测绘人员进行测绘活动时，应当持有合法有效的测绘作业证件。测绘单位和测绘人员进行测绘活动，应当提前告知有关单位或者个人，并出示证件。
任何单位和个人不得妨碍和阻扰测绘人员依法进行测绘活动。
Article 21
The professional technicians engaging in surveying and mapping activities in this City shall obtain the corresponding qualifications as stipulated by the State.
In conducting surveying and mapping activities, the surveying and mapping personnel shall carry legal and valid certificates for surveying and mapping operation. Before conducting such surveying and mapping activities, the surveying and mapping units and personnel shall notify relevant unit (s) or individual (s) in advance and show their certificates.
Any unit or individual shall not hinder, stop or interfere with the surveying and mapping carried out by surveying and mapping personnel in accordance with law.
第二十二条鼓励本市依法成立的测绘地理信息行业社团组织，积极参与测绘地理信息市场建设，充分发挥在行业自律、行业宣传及推广、技术咨询及培训、科技交流及合作、评奖评优、行业信用体系建设等方面的积极作用。
Article 22
The social organizations of surveying, mapping and geoinformation established in this City in accordance with law shall be encouraged to actively participate in developing the surveying, mapping and geoinformation market and play their active role in such aspects as self-regulation, sector propaganda and promotion, technical consultancy and training, science and technological exchanges and cooperation, commending and awarding and the credit system construction of this sector.
第二十三条测绘项目应当实行政府采购、招标的，按照相关法律、法规的规定执行。经市测绘地理信息主管部门和相关部门批准后，以下测绘项目可以不进行招标：
（一）涉及国家安全、国家秘密的；
（二）涉及抢险救灾；
（三）法律、法规规定的其他不适宜招标的项目。
Article 23
Where a governmental purchase or a bid shall be made for a surveying and mapping project, such a purchase or bid shall be executed in accordance with relevant laws and regulations. Upon the approval of the competent departments of surveying, mapping and geoinformation at the municipal level, the following surveying and mapping projects may be implemented without a bid:
(1) Projects that involve the State security or State secrets;
(2) Projects that involve rescue and disaster relief; and
(3) Other projects that are not suitable for a bid stipulated by laws and regulations.
第二十四条项目单位采用招标或者其他方式确定测绘单位时不得有下列行为：
（一）让不具有相应测绘资质的测绘单位或个人承接业务；
（二）让测绘单位低于测绘成本承接业务；
（三）将整体测绘项目化整为零或者以其他方式规避测绘资质的作业限额；
（四）指使测绘单位不按国家、地方技术标准和规范进行测绘或者伪造相应成果；
（五）法律、法规禁止的其他行为。
Article 24
When choosing a surveying and mapping unit through a bidding or by any other means, a unit in charge of a project shall not conduct the following acts:
(1) Allowing a surveying and mapping unit or an individual having no corresponding qualification of surveying and mapping to undertake the work to undertake the work;
(2) Making a surveying and mapping unit undertake the work of surveying and mapping at a price lower than the cost;
(3) Breaking up the whole surveying and mapping project into parts or evading the activity quota of surveying and mapping qualification by any other means;
(4) Instigating a surveying and mapping unit to conduct surveying and mapping activities in violation of the national and local technical standards and norms or to forge the corresponding results; and
Other acts prohibited by laws and regulations.
第二十五条测绘单位应当按照测绘资质证书规定的业务范围和作业限额承接项目，并与项目单位采取合同书的形式订立合同。禁止下列行为：
（一）超越资质等级许可的范围从事测绘活动；
（二）以其他单位的名义从事测绘活动；
（三）允许其他单位或者个人以本单位的名义从事测绘活动；
（四）转让、违法分包测绘项目；
（五）不按国家、地方技术标准和规范进行测绘或者伪造相应成果；
（六）法律、法规禁止的其他行为。
Article 25
A surveying and mapping unit shall undertake projects in accordance with the business scope and activity quota as stipulated by its surveying and mapping qualification certificate, and enter into a contract with a project unit in the form of written contractual agreements. It shall be prohibited from conducting the following acts:
(1) Engaging in surveying and mapping activities beyond the scope permitted for its qualification grade;
(2) Engaging in surveying and mapping activities in the name of other units;
(3) Allowing other units or individuals to engage in surveying and mapping activities in their names;
(4) Transferring or illegally subcontracting surveying and mapping projects;
(5) Failing to conduct surveying and mapping activities in conformity with the State’s and local technical standards and norms, or counterfeiting corresponding results;
(6) Other acts prohibited by laws and regulations.
第二十六条编制本市各种地图和提供互联网地图服务应当符合下列要求：
（一）取得相应的测绘资质，并在资质等级许可的范围内开展相应业务；
（二）地图的内容表示应当符合国家、广东省的有关规定，使用标准地名和行政区域界线标准画法；
（三）正确反映各要素的地理位置、形态及相互关系。
Article 26
When drawing local maps and providing services of Internet maps, the surveying and mapping unit shall meet the following requirements:
(1) The unit shall obtain the corresponding qualification for surveying and mapping, and carry out corresponding business within the scope permitted for its qualification grade;
(2) The content of maps shall conform to relevant provisions of the State and Guangdong Province and standard place names and the standard drawing of administration boundaries of the administration areas shall be applied;
(3) The geographic locations and shapes of all the elements and their relationship shall be reflected correctly.
第二十七条出版、展示、登载、生产本市各种地图，相关单位应当将样图一式两份报市测绘地理信息主管部门审核，依法取得审图号，再按照规定办理相关手续。
经审核批准的地图和附有地图的产品，送审单位应当在发行、登载、展示、销售前将样品或者样图一式两份报审批部门备案。
在互联网上提供地图服务的，应当遵守国家、本省的有关规定。
Article 27
When publishing, displaying, covering and producing all kinds of maps of this City, relevant units shall submit the samples of maps in duplicate to the competent departments of surveying, mapping and geoinformation at the municipal level for review, obtain the map review number in accordance with law before completing relevant procedures as stipulated by provisions.
After such maps and products to which maps are attached are approved upon review, the submitting unit shall, prior to publishing, covering, displaying and selling such maps and products, submit samples or master drawings thereof in duplicate to an approval department for record-filing.
A unit which provides map services on the Internet shall abide by relevant provisions of the State and this Province.
第五章 测绘成果
Chapter V Surveying and Mapping Results
第二十八条市、区测绘地理信息主管部门应当建立测绘成果质量监督检查制度，加强对测绘成果质量的监督管理。
测绘单位应当建立健全质量保障体系，对其完成的测绘成果质量负责，测绘成果未经检验或者检验不合格的，不得交付使用。
基础测绘项目应当通过市测绘地理信息主管部门组织实施的测绘成果质量检验合格后，方可实施项目验收。
Article 28
The competent departments of surveying, mapping and geoinformation at the municipal and district levels shall set up a quality supervision and inspection system for surveying and mapping results to strengthen the supervision and administration over the quality of surveying and mapping results.
A surveying and mapping unit shall establish and improve a quality guarantee system and be responsible for the surveying and mapping results it has obtained. Surveying and mapping results that are not inspected or fail the inspection shall not be delivered for use.
Basic surveying and mapping projects may be examined and accepted only after passing the quality inspection of surveying and mapping results organized by the competent departments of surveying, mapping and geoinformation at the municipal level.
第二十九条测绘成果实行无偿汇交。属于基础测绘成果的，应当汇交测绘成果副本；属于其他测绘成果的，应当汇交测绘成果目录。其他测绘成果中使用财政资金完成的以及可用于更新基础地理信息数据的测绘成果，也应当汇交测绘成果副本。
测绘项目出资人或者承担使用财政资金的测绘项目的单位应当在测绘成果验收合格后三个月内，向市测绘地理信息主管部门完成汇交。市测绘地理信息主管部门应当在收到汇交的测绘成果副本或者目录后出具汇交凭证。具体汇交方式由市测绘地理信息主管部门另行规定。
Article 29
Surveying and mapping results shall be summarized and submitted free of charge. If the surveying and mapping results belong to those of a basic surveying and mapping project, they shall be summarized and submitted in the form of a duplicate copy; and if they do not belong to those of a basic surveying and mapping project, they shall be summarized and submitted in the form of a catalogue. Other surveying and mapping results which are completed by using fiscal funds and used for the update of basic geoinformation and data shall be summarized and submitted in the form of a duplicate copy.
Investors for surveying and mapping projects or units undertaking surveying and mapping projects using fiscal funds shall, within three months from the date when the said projects are examined and accepted, summarize and submit the surveying and mapping results to the competent departments of surveying, mapping and geoinformation at the municipal level. Such departments shall, after receiving the copies or catalogues of the surveying and mapping results, produce vouchers for receipt of such copies or catalogues. Summarization and submission methods shall be separately prescribed by the competent departments of surveying, mapping and geoinformation at the municipal level.
第三十条市测绘地理信息主管部门应当及时对汇交的测绘成果进行质量检查，检查合格后更新至市级地理信息时空数据库并向汇交单位出具测绘成果入库凭证，检查不合格的返回汇交单位重新修改。入库的测绘成果应当实时分发至对应的区级地理信息时空数据库。
Article 30
The competent departments of surveying, mapping and geoinformation at the municipal level shall inspect the quality of the summarized and submitted surveying and mapping results in a timely manner. If such results pass the inspection, the said departments shall update such results to the spatiotemporal database of geoinformation at the municipal level and issue the summarizing and submitting units with vouchers for including such surveying and mapping results into the database and if such results fail the inspection, they shall be returned to the summarizing and submitting units for revision. The surveying and mapping results included into the database shall be distributed to the corresponding spatiotemporal database of geoinformation at the district level in real time.
第三十一条市测绘地理信息主管部门应当编制测绘成果目录，实行动态管理，定期向社会公布，并按照规定将入库的测绘成果副本和目录向省测绘地理信息主管部门汇交。
政府有关部门办理审批业务需要使用测绘成果作为审批材料的，应当使用入库的测绘成果。
Article 31
The competent departments of surveying, mapping and geoinformation at the municipal level shall compile catalogues of the surveying and mapping results, conducting dynamic administration of such catalogues, regularly make them public and in accordance with provisions, summarize and submit the copies and catalogues of the surveying and mapping results included into the database to the competent departments of surveying, mapping and geoinformation at provincial level.
In case any surveying and mapping results are needed as the approval materials by the relevant government departments for completing the approval, the surveying and mapping results included into the database shall be used.
第三十二条基础测绘成果由市测绘地理信息主管部门负责管理，并按照国家、省有关规定委托测绘成果保管单位负责具体实施。非基础测绘成果由项目单位负责保管、维护，并按照国家相关规定提供使用。
测绘成果保管单位的硬件设施、信息安全保密管理制度应当符合相关法律、法规的规定。
测绘成果属于国家秘密的，其密级的确定、变更、解密及其复制、使用、转让、转借、保管，依照保密法律、法规的规定执行。
Article 32
The competent departments of surveying, mapping and geoinformation at the municipal level shall be responsible for the management of basic surveying and mapping results, and in accordance with relevant provisions of the State and province, entrust units in charge of keeping surveying and mapping results to perform such management. Results that do not belong to basic surveying and mapping projects shall be kept and maintained by project units and be provided for use in accordance with relevant provisions of the State.
The facilities and the system of information security, confidentiality and administration of the units in charge of keeping surveying and mapping results shall conform to the provisions of relevant laws and regulations.
Where the surveying and mapping results are State secrets, they shall be classified into different categories. The categories shall be altered and the results shall be declassified, duplicated, used, transferred, lent and kept in accordance with provisions of laws and regulations on guarding secrets.
第三十三条测绘成果的生产、使用和保管单位应当建立测绘成果档案管理及使用制度，并接受市、区测绘地理信息主管部门的监督检查。有下列情形之一的，其测绘成果档案管理及使用应当认定为不合格，并纳入信用档案：
（一）拒绝接受监督检查或者不如实提供检查所需资料的；
（二）测绘项目不归档或者归档不全导致档案严重缺失且拒绝改正的；
（三）弄虚作假或者伪造测绘成果及资料档案的。
（四）其他导致测绘成果无法实行可追溯管理的情形。
Article 33
A unit in charge of producing, using and keeping surveying and mapping results shall establish a system for managing and using archives of surveying and mapping results, and be supervised and inspected by the competent departments of surveying, mapping and geoinformation at the municipal and district levels. In case any of the following circumstances occurs, the administration and use of archives of surveying and mapping results shall be deemed to fail, which shall be included in credit archives:
(1) Refusing to receive supervision and inspection or untruthfully providing materials required for inspection;
(2) Failing to archive the surveying and mapping projects or archiving them incompletely, leading to a serious lack of archives, and refusing to make corrections;
(3) Engaging in fraud or counterfeiting surveying and mapping results and archives of materials; or
(4) Other circumstances that lead to the failure of traceable administration of surveying and mapping results.
第三十四条政府各相关部门因履行职责需要，可以无偿使用地理信息共享平台开展其专业领域的地理信息应用，所需的基础地理信息数据由市、区测绘地理信息主管部门按照有关规定提供。
市、区测绘地理信息主管部门因履行职责需要，可以无偿使用政府各相关部门的共享专题地理信息数据，相关部门应当予以配合并按照有关规定提供数据。
Article 34
Relevant government departments, upon the need of duty performance, may utilize free of charge the sharing platform of geoinformation to carry out the application of geoinformation in their professional fields. The required basic geoinformation data shall be provided by the competent departments of surveying, mapping and geoinformation at the municipal and district levels in accordance with relevant provisions.
The competent departments of surveying, mapping and geoinformation at municipal and district levels, upon the need of duty performance, may utilize free of charge the sharing special geoinformation data provided by relevant government departments. Such relevant departments shall cooperate and provide the said data in accordance with relevant provisions.
第三十五条市、区测绘地理信息主管部门应当推进公众版地理信息数据的生产和更新工作，通过地理信息共享平台为公众、社会组织提供浏览、查询、接口等在线服务，实现地理信息乐动体育如何充钱 共享。
Article 35
The competent departments of surveying, mapping and geoinformation at the municipal and district levels shall promote the production and update of public geoinformation data and provide the public and social organizations with such online services as browsing, inquiry and connections through the sharing platform of geoinformation so as to make geoinformation data available and shared to the public.
第六章 测量标志保护
Chapter VI Protection of Surveying Markers
第三十六条建设永久性测量标志应当符合下列要求：
（一）执行国家、地方规定的技术标准和规范；
（二）符合使用目的；
（三）附近无其他可利用的测量标志；
（四）便于长期保护和管理。
Article 36
The establishment of permanent surveying markers shall meet the following requirements:
(1) The technical standards and norms stipulated by the State and local government shall be performed;
(2) Such establishment shall conform to the purpose of use;
(3) There are no other available surveying markers nearby;
(4) It shall be conducive to permanent protection and administration of the surveying markers.
第三十七条永久性测量标志建造前，建设单位应当将标志设计图、埋设位置、保护范围、占用土地或设施的权属单位等材料按管理职责报市、区测绘地理信息主管部门备案，并在建造后书面告知标志所在地的镇人民政府、街道办事处和占用土地或设施的权属单位。
Article 37
Before the construction of permanent surveying markers, the construction unit shall,, in accordance with its administrative duties and responsibility, submit materials including the design drawings of the markers, burying location, protection scope and information about the authorities occupying land or facilities, to the competent departments of surveying, mapping and geoinformation at the municipal and district levels for record-filing, and after the construction, send a written notice to the town people’s government, subdistrict office and authorities occupying land or facilities of the markers’ location.
第三十八条永久性测量标志的建设单位应当对永久性测量标志设立明显标识。
市、区测绘地理信息主管部门认定的高等级永久性测量标志，其标识应当标明损害永久性测量标志的法律责任及保管责任人的联系方式。
Article 38
A unit which establishes permanent surveying markers shall set up distinct signs for such markers.
The signs for high-level permanent surveying markers recognized by the competent departments of surveying, mapping and geoinformation at the municipal and district levels shall indicate the legal liability for the damage to such markers and the contact information about the persons in charge of keeping such markers.
第三十九条市、区测绘地理信息主管部门应当建立永久性测量标志档案，定期对永久性测量标志进行普查和维护，并按照规定向国土、规划、建设等有关部门发布。国土、规划、建设等部门在审批有可能对永久性测量标志用地和使用效能造成影响的项目前，应当征求同级测绘地理信息主管部门的意见。
Article 39
The competent departments of surveying, mapping and geoinformation at the municipal and district levels shall set up archives for permanent surveying markers, survey and maintain such markers on a regular basis, and in accordance with provisions, publish such archives to the land, planning and construction departments. The land, planning and construction departments shall, before approval of projects which may influence the land used for permanent surveying markers and effective utilization thereof, seek opinions from the competent departments of surveying, mapping and geoinformation at the same level.
第七章 法律责任
Chapter VII Legal Liability
第四十条违反本办法规定，测绘地理信息主管部门或者相关部门的工作人员有下列行为的，由本级人民政府对负有责任的领导人员和其他直接责任人员依法给予处分；构成犯罪的，依法追究刑事责任：
（一）利用职务上的便利索取、收受他人财物或者谋取其他利益的；
（二）办理审批业务或者查处违法行为中，滥用职权、玩忽职守的；
（三）不依法履行监督管理职责，造成严重后果的。
Article 40
Where a functionary of the competent departments of surveying, mapping and geoinformation or other relevant departments, in violation of the provisions of these Measures, conducts any of the following circumstances, the leaders directly in charge and persons directly liable shall be given punishment by the people’s government at the same level in accordance with the law; where a crime is constituted, they shall be held liable in accordance with the criminal law:
(1) By taking advantage of his job, accepting others’ money or things of value or seeking other benefits;
(2) Abusing his power or neglecting his duties in the completion of approval business or investigation of misconduct;
(3) Failing to perform his duty of supervision in accordance with the law, leading to serious consequences.
第四十一条违反本办法规定，测绘地理信息主管部门或者相关部门的工作人员有下列行为的，由本级人民政府责令改正，通报批评。
（一）办理审批业务需要使用测绘成果作为审批材料，未使用入库后的测绘成果的。
（二）未按规定利用已有测绘成果，造成重复建设和资源浪费的。
Article 41
Where a functionary of the competent departments of surveying, mapping and geoinformation or other relevant departments, in violation of the provisions of these Measures, conducts any of the following circumstances shall be ordered to make corrections and criticized in a circulated notice by the people’s government at the same level.
(1) Using surveying and mapping results other than the results included into the database where surveying and mapping results are required as approval materials in the completion of approval.
(2) Failing to make use of the available surveying and mapping results as stipulated, leading to duplicate construction and waste of resources.
第四十二条违反本办法第二十一条第三款规定的，由公安机关依照《中华人民共和国治安管理处罚法》第二十三条的规定予以处罚。
Article 42
Any unit that violates Article 21(3) hereof shall be given punishment by the public security authorities in accordance with Article 23 of Law of the People's Republic of China on Penalties for the Violation of Public Security Administration.
第四十三条违反本法第二十四条第（一）项、第（二）项规定的，由测绘地理信息主管部门责令改正，可以处测绘约定报酬二倍以下的罚款。项目单位的工作人员利用职务上的便利，索取他人财物，或者非法收受他人财物为他人谋取利益的，依法给予处分；构成犯罪的，依法追究刑事责任。
Article 43
Any unit that violates Article 24(1) and (2) hereof shall be ordered to make corrections by the competent departments of surveying, mapping and geoinformation and fined not more than two times the amount of the remuneration for surveying and mapping agreed upon. Where a functionary of a project unit, by taking advantage of his position, extorts money or thing of value from others or illegally accepts money or things of value to seek benefits for others, he shall be given punishment in accordance with the law; if a crime is constituted, he shall be held liable in accordance with the criminal law.
第四十四条违反本办法第二十四条第（三）项的，由测绘地理信息主管部门责令限期改正，可以处项目合同金额千分之五以上千分之十以下的罚款；对全部或者部分使用财政资金的项目，可以暂停项目执行或者暂停资金拨付；对单位直接负责的主管人员和其他直接责任人员依法给予处分。
Article 44
Any unit that violates Article 24(3) hereof shall be ordered to make corrections within a specified time limit by the competent departments of surveying, mapping and geoinformation and fined not less than five thousandths but not more than ten thousandths of the amount of the project contract; the projects that use fiscal funds in whole or in part shall be suspended to carry out or to be given funding; and the persons directly in charge and the other persons directly liable shall be given punishment in accordance with the law.
第四十五条违反本办法第二十四条第（四）项规定的，由测绘地理信息主管部门责令改正，可以处1万元以上5万元以下的罚款。
Article 45
Any unit that violates Article 24(4) hereof shall be ordered to make corrections by the competent departments of surveying, mapping and geoinformation and fined not less than CNY10,000 but not more than CNY50,000.
第四十六条违反本办法第二十五条第（一）项、第（二）项、第（三）项规定的，由测绘地理信息主管部门责令停止违法行为，没收违法所得和测绘成果，处测绘约定报酬二倍的罚款，并可以责令停业整顿或者提请发证部门降低其测绘资质等级；情节严重的，提请发证部门吊销其测绘资质证书。
Article 46
Where any unit violates Article 25(1), (2) and (3) hereof, the competent departments of surveying, mapping and geoinformation shall order it to desist from the violation, confiscate its illegal gains and surveying and mapping results and give it a fine of two times the amount of the agreed remuneration for surveying and mapping, and may order it to suspend operation for shake-up or apply to the certificate issuing department for downgrading its qualification for surveying and mapping; and in the case of a serious violation, the competent departments shall apply to the certificate issuing department for revoking the unit’s qualification certificates for surveying and mapping.
第四十七条违反本办法第二十五条第（四）项规定的，由测绘地理信息主管部门责令改正，没收违法所得，处测绘约定报酬二倍的罚款，并可以责令停业整顿或者提请发证部门降低其测绘资质等级；情节严重的，提请发证部门吊销其测绘资质证书。
Article 47
Where any unit violates Article 25(4) hereof, it shall be ordered to make corrections by the competent departments of surveying, mapping and geoinformation, illegal gains shall be confiscated, and it shall be fined two times the amount of the remuneration for surveying and mapping agreed upon. In addition, it may be ordered to suspend operation for shake-up or its qualification for surveying and mapping may be downgraded by the department that issues the certificate; and in the case of a serious violation, its qualification certificates for surveying and mapping shall be revoked by the department that issued the certificate.
第四十八条违反本办法第二十五条第（五）项规定的，由测绘地理信息主管部门，责令改正，可以处1万元以上5万元以下的罚款。
Article 48
Any unit that violates Article 25(5) hereof shall be ordered to make corrections by the competent departments of surveying, mapping and geoinformation and fined not less than CNY10,000 but not more than CNY50,000.
第四十九条违反本办法第二十七条第一款、第二款规定的，由测绘地理信息主管部门责令停止违法行为，并处3000元以上1万元以下的罚款。
Article 49
Any unit that violates Article 27(1) and (2) hereof shall be ordered to desist from the violation by the competent departments of surveying, mapping and geoinformation and fined not less than CNY3,000 but not more than CNY10,000.
第五十条违反本办法第二十九条规定的，由测绘地理信息主管部门责令限期汇交；测绘项目出资人逾期不汇交的，处重测所需费用二倍的罚款；承担使用财政资金的测绘项目的单位逾期不汇交的，处5万元以上20万元以下的罚款，并提请发证部门暂扣其测绘资质证书，自暂扣测绘资质证书之日起六个月内仍不汇交的，提请发证部门吊销其测绘资质证书；对直接负责的主管人员和其他直接责任人员，依法给予处分。
Article 50
Any unit that violates Article 29 hereof shall be ordered to summarize and submit the materials of its surveying and mapping results within a specified time limit; if it fails to do so at the expiration of the time limit, the investors for the surveying and mapping project shall be fined two times the amount of the expenses entailed by resurveying and remapping the project; and the unit undertaking the surveying and mapping project using fiscal funds shall be fined not less than CNY50,000 but not more than CNY200,000 and its qualification certificate for surveying and mapping shall be temporarily detained by the department that issued the certificate. If the unit still fails to summarize and submit the materials of the surveying and mapping results within six months from the date when its qualification certificate is temporarily detained, its qualification certificate shall be revoked by the department that issued the certificate; and the persons directly in charge and the other persons directly liable shall be given punishment in accordance with the law.
第八章 附则
Chapter VIII Supplementary Provisions
第五十一条本办法自2018年**月**日起施行。
Article 51 These Measures shall come into effect as of ** **, 2018.
